Welcome to My Fish Vault. These Terms of Service ("Terms") govern your access to and use of our fishing tracking application and services.
By creating an account and using My Fish Vault, you agree to be bound by these Terms. If you do not agree, please do not use our services.
By accessing or using My Fish Vault, you agree to comply with and be legally bound by these Terms, whether or not you register as a user.
We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the service after changes constitutes acceptance of the new Terms.
- You must be at least 13 years of age to use My Fish Vault
- If you are under 18, you must have parental or guardian consent
- You must provide accurate and complete information during registration
- You are responsible for maintaining the security of your account credentials
You agree to:
- Provide accurate, current, and complete account information
- Maintain the security and confidentiality of your password
- Notify us immediately of any unauthorized account access
- Accept responsibility for all activities under your account
- Not share your account with others
- Not create multiple accounts to circumvent restrictions
Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose security risks.
Free Plan:
- Limited to 40 catch cards maximum
- 1 photo per catch
- Basic features included at no cost
Premium Subscription ($19.99/year):
- Unlimited catch cards
- Up to 4 photos/videos per catch
- Access to Fishing Guides directory
- Access to Fishing Resorts directory
- Advanced features and analytics
7-Day Premium Free Trial:
- New accounts may start a one-time 7-day free trial of Premium
- No credit card or payment information is required to start the trial
- The trial gives full access to Premium features for 7 calendar days
- The trial does not convert into a paid subscription and you will not be charged automatically
- When the trial ends, your account returns to the Free plan and your catch data remains saved
- Limited to one trial per user; creating additional accounts to obtain extra trials is prohibited
- We may modify or discontinue the trial offer at any time
Guide & Resort Listing Subscriptions:
- Fishing Guide listing: $69.99/year — featured placement in your state's guide directory
- Fishing Resort listing: $89.99/year — featured placement in your state's resort directory
- Both listing subscriptions bill annually and renew automatically until cancelled
- Listings become active only after your application is approved and your first payment succeeds
- A listing subscription includes Premium Membership benefits at no extra cost while the subscription is active
- If the listing subscription is cancelled, expires, or payment fails, your listing is removed from the directory and the included Premium benefits end at the same time
- Premium access continues only if you separately hold a paid Premium subscription of your own
- Booking fees are separate from listing subscriptions — see Section 8
Payment Terms:
- All payments processed securely through Stripe
- Subscriptions renew automatically each year unless cancelled
- Renewal reminders sent 30 days and 7 days before renewal
- You may cancel anytime from your Account page
- Upon cancellation, you retain Premium access until the end of your billing period
- Prices subject to change with 30 days notice
- All sales are final - no refunds except as required by law
Cancellation Policy: Cancel anytime - no questions asked. You keep Premium access until your paid period ends. Your catch data remains saved after downgrade to Free.
Your Content:
You retain ownership of all content you create (catch records, photos, videos, notes). By using My Fish Vault, you grant us a limited license to store, display, and process your content to provide our services.
- Your fishing data is private and not shared publicly
- We do not claim ownership of your content
- You may delete your content at any time
- If you choose to share catches publicly, you grant us permission to display that content
Content Standards:
- Content must be fishing-related
- No inappropriate, offensive, or illegal content
- No copyrighted material without permission
- No harassment, hate speech, or threatening content
- No spam or misleading information
Content Moderation: We reserve the right to review, remove, or refuse any content that violates our policies. Violations may result in account suspension or termination.
You agree NOT to:
- Violate any laws, regulations, or these Terms
- Upload malicious code, viruses, or harmful software
- Attempt to hack, interfere with, or disrupt the service
- Access another user's account without permission
- Scrape, copy, or download user data without authorization
- Use bots, scripts, or automated tools without permission
- Impersonate others or misrepresent your identity
- Engage in fraudulent activities or payment disputes
- Upload inappropriate or illegal content
- Harass, abuse, or threaten other users
- Reverse engineer or decompile the application
IMPORTANT: My Fish Vault is a DIRECTORY SERVICE ONLY for fishing guides and resorts.
- We do NOT employ, endorse, or contract with guides/resorts
- We do NOT conduct background checks or verify credentials
- All agreements are between you and the guide/resort directly
- We assume NO LIABILITY for services, disputes, injuries, or damages
- You are responsible for verifying licenses, insurance, and safety
- Use the directory at your own risk
BY USING THE GUIDE/RESORT DIRECTORY, YOU ACKNOWLEDGE THAT MY FISH VAULT ASSUMES NO RESPONSIBILITY FOR ANY AGREEMENTS, SERVICES, OR OUTCOMES.
Booking Fee (Guides & Resorts):
- When a guide or resort confirms a booking, they pay a 5% booking fee to My Fish Vault
- This fee is charged immediately upon booking confirmation via Stripe
- The fee covers platform services, payment processing, and customer support
NON-REFUNDABLE BOOKING FEE POLICY
- The 5% booking fee is NON-REFUNDABLE under all circumstances
- This applies even if the customer cancels the booking
- This applies even if the guide/resort cancels the booking
- This applies regardless of weather, emergencies, or any other reason
- No exceptions - the booking fee is earned when the booking is confirmed
Customer Refunds:
- All refunds to customers are handled directly between the customer and the guide/resort
- My Fish Vault does not collect payment from customers and therefore does not issue refunds
- Each guide/resort sets their own cancellation policy
- Customers must review and accept the cancellation policy before booking
- Disputes about refunds must be resolved between the customer and provider
Payment Flow:
- Customer submits booking request (no payment to My Fish Vault)
- Guide/resort reviews and confirms or declines the request
- Upon confirmation, guide/resort is charged 5% booking fee (non-refundable)
- Customer pays guide/resort directly for the service
- If cancelled, customer seeks refund directly from guide/resort per their policy
BY CONFIRMING A BOOKING, GUIDES AND RESORTS ACKNOWLEDGE THAT THE 5% FEE IS NON-REFUNDABLE. BY SUBMITTING A BOOKING REQUEST, CUSTOMERS ACKNOWLEDGE THAT REFUNDS ARE HANDLED DIRECTLY WITH THE PROVIDER.
My Fish Vault and its original content, features, functionality, design, logo, and trademarks are owned by My Fish Vault and protected by international copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our services without explicit written permission.
"AS IS" Service:
My Fish Vault is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee the service will be uninterrupted, error-free, or secure.
Limitation of Liability:
To the maximum extent permitted by law, My Fish Vault shall NOT be liable for:
- Loss of data, profits, or business opportunities
- Indirect, incidental, or consequential damages
- User errors or misuse of the service
- Third-party actions (guides, resorts, payment processors)
- Service interruptions or technical failures
Data Storage & Third-Party Hosting:
- All data collected, acquired, or otherwise obtained through My Fish Vault (including account information, catch records, photos, videos, and notes) is stored on servers owned and operated by Base44, our third-party hosting and platform provider.
- My Fish Vault does not own, hold, or save user data on its own systems.
- In the event that any data is lost, corrupted, or cannot be accessed or retrieved, users must address the matter directly with Base44.
- My Fish Vault is not legally or financially responsible for retrieving, restoring, or recovering lost or inaccessible data for users in any capacity.
Maximum Liability: Our total liability to you for any claims shall not exceed the amount you paid for Premium subscription in the past 12 months (or $50 if using Free plan).
You agree to indemnify, defend, and hold harmless My Fish Vault, its officers, employees, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you upload or share
Governing Law:
These Terms are governed by the laws of the United States and the state in which My Fish Vault is registered, without regard to conflict of law principles.
Dispute Resolution:
- First, contact us at Info@mictight.com to resolve informally
- If unresolved, disputes will be settled through binding arbitration, which must be conducted in Mille Lacs County or Crow Wing County, Minnesota
- You waive the right to participate in class-action lawsuits
- Small claims court in Mille Lacs County or Crow Wing County, Minnesota, remains available for qualifying disputes
Your Rights: You may terminate your account at any time from your Account page. Upon termination, your data will be deleted within 90 days.
Our Rights: We reserve the right to suspend or terminate accounts that violate these Terms, engage in prohibited activities, or pose security risks, with or without notice.
Effect of Termination: All provisions that should reasonably survive termination (disclaimers, limitations of liability, indemnification) will remain in effect.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy and Content Policy, constitute the entire agreement between you and My Fish Vault.
